Terms of Service

In force from 25 August 2026.

These terms are a legal agreement between you and Seaglass Projects Ltd, registered in England and Wales (company number 17396371), registered office 16 Eastchurch, Margate, CT9 3EN, United Kingdom. They govern your use of the Nova app and the Nova website at heynova.org (together, the Service).

You agree to these terms when you tick the box confirming them as you create your account. Read them alongside our Privacy Policy, which explains how we handle your information.

Your rights are unaffected. Nothing in these terms affects your statutory rights under the UK Consumer Rights Act 2015, the Australian Consumer Law, or any other consumer protection law that applies to you.

1. What Nova is, and is not

Nova is a fertility patient experience platform. It helps you track treatment cycles, manage medications, record results, share selected information with people supporting you, and review fertility clinics.

Nova is not medical advice. Nothing in the Service — including treatment tracking, medication reminders, or any information displayed — is medical advice, diagnosis or treatment. Nova does not replace your doctor, your clinic or any qualified healthcare professional. Always speak to your medical team before making decisions about your treatment.

Nova is not a medical device. The Service is an information management and personal tracking tool. It is not intended to diagnose, treat, cure or prevent any condition, is not regulated as a medical device, and must not be relied on as one.

Nova records what you tell it. It does not verify anything against your clinic’s records, and it cannot know about a change your clinic has not told you about or any information you have not uploaded to Nova.

Medication reminders are prompts, not prescriptions. Reminders reflect what you have entered. They do not check dosage, timing, interactions or suitability. A reminder to take a medication does not mean you should take it — only your prescribing clinician can decide that. If you are unsure about any medication, contact your clinic before acting on a reminder. Our medical information disclaimer sets this out in full and forms part of these terms.

2. Who can use Nova

You must be 18 or over. You confirm this when you create your account. We do not verify age beyond that confirmation.

If you believe someone under 18 has an account, email privacy@heynova.org and we will look into it and delete the account if it is one. We will tell you when we have.

You may hold one account. One account is enough whether you are having treatment, supporting somebody, or both — a single Nova account does both at once.

3. Your account

Keep your account secure: choose a strong password or use a sign-in provider, and do not share your credentials. You are responsible for what happens under your account. If you think it has been compromised, email support@heynova.org straight away.

4. What you may do

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Nova for your own private, non-commercial purposes: to track your treatment, keep your records, invite people to follow selected parts of it, review clinics you have attended, and use community features when they open.

5. What you must not do

  • Use Nova unlawfully, or in breach of any applicable law
  • Try to reach another person’s account or information
  • Reverse-engineer, decompile or disassemble any part of the Service, except to the extent the law permits you to
  • Use bots, scrapers or crawlers against the Service
  • Interfere with the Service or the infrastructure it runs on
  • Harass, abuse or harm anybody through the Service
  • Submit false, misleading or defamatory content, including fraudulent clinic reviews
  • Impersonate anybody or misrepresent who you are
  • Use the Service commercially without our written consent

6. Your treatment record

Your treatment record — cycles, medications, appointments, results, journal entries, symptoms, embryo and egg records, and clinic contact details — is yours. We hold it on your behalf and claim no ownership of it. You can export it at any time.

We process it only to run the Service, as set out in the Privacy Policy. We do not sell it, use it for advertising, or share it with anyone except as needed to operate Nova.

Journal entries are private by design. There is no sharing category for them. They cannot be shared with a supporter, seen by another user, or reached through any setting — even if you have enabled sharing for everything else. They are not end-to-end encrypted, so like the rest of your record they are readable by our infrastructure, and we may have to disclose information if the law requires it.

7. People who support you

If you invite someone

  • You choose which categories to share. Each is enabled individually and all default to off.
  • Journal entries can never be shared — there is no category for them.
  • You can revoke access at any time, and it takes effect immediately.
  • If you delete your account, all supporter access ends immediately.

You decide what to share and with whom. We provide the controls; the choice is yours, and we are not responsible for what somebody does with information you chose to share with them.

If you are supporting someone

What you can see is somebody else’s health information, shared with you in confidence. You must not screenshot, copy, forward or repeat it to anyone without their agreement. Your access can be withdrawn at any time, without notice and without a reason. If you delete your own account, your access ends and nothing you saw remains available to you.

8. What you pay for, and what paying does not affect

Keeping your treatment history in Nova is free. Tracking a live cycle is a paid feature. Prices are shown before you are asked to pay.

Payment is taken by Apple or Google through their own purchase screen. We never see or hold your card details. Their refund policies apply to a purchase they took, and a refund request goes to them — though we will help where we can. Any renewing product renews automatically until you cancel it through the relevant store; a one-off pass does not renew.

What paying does not affect. Your history, your results, your stored embryo and egg records, your notes, your support circle and your account stay available to you whether or not a treatment pass is running, and stay exportable.

For UK and Australian consumers, your statutory rights to a refund for digital content that is faulty or not as described are unaffected.

9. Clinic reviews

9.1 What a review is

A review is your honest account of the care you received at a fertility clinic. Reviews are rated across six dimensions: communication, waiting times, cost transparency, feeling informed, dignity and respect, and emotional support.

Your treatment outcome is not part of the calculation of a clinic’s overall score, however it is possible to review scores broken down by outcome. You choose whether your outcome is published with your review, counted only in that breakdown, or not used at all.

9.2 What you confirm when you submit one

  • You were a patient at that clinic, or the partner or supporter of one
  • Your review is honest, accurate and based on your own experience
  • It contains no false statements of fact about the clinic or its staff
  • It does not name or identify other patients, or name individual staff
  • Nobody has paid, incentivised or pressured you to write it

9.3 What we publish

Reviews appear on the Nova website and in the app, and search engines can find them. You can publish a review under a display name you choose (section 12), or with no name at all — you decide for each review. A published review shows the treatment type, the year, your six ratings, your title, what you wrote, your outcome where you chose to publish it, and, if you recorded a cycle at that clinic in Nova, a badge reading Tracked in Nova.

That badge is not verification. It means you told Nova you had a cycle at that clinic. We have not checked it with the clinic, and anybody can record a cycle without having been treated anywhere. The full sentence appears beneath every review that carries the badge, so a reader does not have to come here to find out what it means.

A display name is also not the same as being anonymous. A clinic often has few enough patients that a detailed review identifies you to them, and a display name connects your reviews to one another so they can be read together. Please leave out any detail you would not want the clinic to be able to place, and remember that anything you write about someone else — a partner, a donor, a child — is published too.

Clinic scores are held back until enough reviews exist to publish one fairly. Below that point, reviews are held but not published.

9.4 Moderation, and the clinic’s reply

Nothing publishes automatically. A person reads every review against our moderation policy before it appears. We may ask you to change something, or decline to publish. We may also remove or ask you to amend a review that contains false statements of fact, is defamatory, abusive or threatening, identifies another patient, was not written by a genuine patient or supporter, breaks the law, or that we reasonably believe was submitted in bad faith.

The clinic is always given a right of reply, shown directly beneath the review it answers. Every published review carries a link to report it.

9.5 Changing your mind

You can see every review you have written in the app, published or not. You can edit one for 30 days after it is published, and withdraw it at any time. Withdrawing removes it from Nova immediately, though search engines may hold a copy for a while. If you delete your account, your reviews are deleted with it, and clinic scores are recalculated without them.

9.6 Permission to publish

You keep ownership of what you write. By submitting a review you give us permission to publish, display, store and distribute it as part of the Service, and to reproduce extracts of it in material about Nova. This permission lasts as long as the review does and ends when the review is withdrawn or deleted.

10. Clinics

A clinic may claim its profile on Nova by verifying an email address at its own domain. A claimed clinic can reply publicly to reviews about it, see aggregate scores for its own profile, and correct factual details about the clinic.

If you claim a clinic profile you confirm that you are authorised to act for that clinic, and you agree:

  • not to write, commission or incentivise reviews of your own clinic or of another;
  • not to use Nova to identify, contact or pressure a reviewer, or to make continued care conditional on a review being changed or withdrawn;
  • that a reply is published as written and subject to the same moderation as a review;
  • that any information you see about aggregate scores is for your clinic’s own use and not for publication as a comparative claim.

We may remove a claim, a reply or a clinic’s access for breach of these terms. Disputes about a specific review go through the report route on that review, which we will consider against our moderation policy and, where appropriate, put to the reviewer.

11. Community features

Nova may include community features such as forums, discussions and peer support. These are in development. When they open, community guidelines will be published and will apply alongside these terms, together with a route to report content and a stated process for dealing with illegal or harmful material.

Community profiles are pseudonymous: you choose a display name that is separate from your treatment record, and your account identity is never shown to other members (see section 12).

Reports about other users are kept. If you report somebody’s conduct, that report is retained even if you later delete your account, because it may protect somebody else. Your identity is detached from it. You accept this when you file a report.

12. Your display name

You can choose a display name to publish alongside your reviews and, when community features open, your community posts. It is a name you pick, not your own, and it is not publicly connected to your treatment record.

One display name covers both places, so choose one you are content to use in each. You can change it, within limits we apply to stop names being cycled to avoid accountability, and changing it changes the name shown on reviews you have already published.

Your display name must not impersonate another person, a clinic, a clinician or Nova itself, and must not be offensive. We may require you to change it, and we may stop showing it if your account is suspended.

13. Reminders

Nova can send medication reminders by push notification. They are opt-in and never on by default. They are discreet by default — the notification says “You have something due” without naming the medication, and detailed notifications are a separate opt-in. They are based only on what you have entered.

Delivery is not guaranteed. Push notifications depend on your device, operating system, browser and network. We make reasonable efforts, but we cannot guarantee that every reminder arrives, or arrives on time. Do not rely on Nova as your only way of remembering to take medication. A missed reminder is not a safe substitute for medical supervision.

14. Availability and changes to Nova

We aim to keep Nova available but cannot guarantee uninterrupted access; it may be unavailable for maintenance, updates or reasons beyond our control.

We may change or remove features. If a change materially reduces something you are paying for, we will give you reasonable notice and, where it is fair to do so, a refund of the unused part.

If we discontinue Nova entirely we will give you at least 30 days’ notice and a way to export everything before it closes.

15. Our intellectual property

Nova — its design, code, branding, written content and illustrations, excluding anything users create — belongs to Seaglass Projects Ltd or its licensors.

Parts of Nova are built on open-source software and on public data used under its own licence, including information published by the Human Fertilisation and Embryology Authority and postcode data published under the Open Government Licence.

“Nova” and the Nova logo are our trade marks. Nothing in these terms gives you the right to use them, or anything else that identifies Nova, without our written consent.

16. Suspension and ending your account

We may suspend or close your account if you breach these terms, if you use Nova in a way that could harm other people, the Service or us, if we are required to by law, or if we reasonably believe your account has been compromised.

Wherever we can, we will tell you first and give you a chance to export your record. For serious or repeated breaches, or where the law requires us to act immediately, we may act without notice. If you think we have got it wrong, email support@heynova.org and a person will review the decision.

17. Deleting your account

You can delete your account at any time from within the app, or by emailing privacy@heynova.org. Deletion is immediate and permanent — not an archive, not a soft delete. Export anything you want to keep first.

When you delete your account:

  • your treatment records are permanently deleted — cycles, medications, schedules, doses, appointments, milestones, events, journal entries, symptoms, embryos, egg batches, clinic contacts and clinic logs;
  • clinic reviews you have written are deleted, published or not, and clinic scores are recalculated without them;
  • your display name and sign-in identity is deleted, and you cannot sign back in;
  • all supporter access ends immediately;
  • your push notification subscriptions are removed;
  • reports you have filed about other users are kept, with your identity detached (section 11);
  • a deletion receipt is created recording which tables were affected and how many rows were removed — counts only, never content.

Deleted data may remain in encrypted backups for up to 7 days before those backups are rotated out. We do not go into backups to retrieve deleted data, and we will not restore it on request.

18. Disclaimers

Nova is provided “as is”. To the maximum extent the law permits, we give no warranties beyond those set out in these terms. In particular we do not warrant that Nova will always be available or free from errors, that it will meet your particular requirements, or that reminders will be delivered on time or at all.

For UK consumers: nothing in this section affects your rights under the Consumer Rights Act 2015. Digital content must be of satisfactory quality, fit for purpose and as described; if it is not, you may be entitled to a repair, a replacement or a refund.

For Australian consumers: nothing in this section excludes or limits the guarantees under the Australian Consumer Law, which cannot be excluded.

19. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law — including under the Consumer Rights Act 2015 or the Australian Consumer Law.

We are not responsible for clinical decisions. Nova is not a medical service. We are not responsible for any clinical decision you make, any medication you take or do not take, or any treatment outcome. Your medical team is responsible for your care.

Subject to the paragraphs above, and to the maximum extent the law permits, we are not liable for loss of profit, loss of business, or any loss that was not reasonably foreseeable when you started using Nova. Our total liability for all other claims is limited to the greater of the amount you paid us in the 12 months before the claim, or £200.

We are responsible for looking after your record and we do not exclude that responsibility. But Nova holds only the data that you have provided it with — your clinic keeps the authoritative record of your treatment, and Nova is not a substitute for it. You can export everything you have recorded at any time, and we recommend you keep your own copy of anything you would not want to lose.

If we do lose or damage your record, our liability is subject to the limit set out above. We are not liable for loss of profit, loss of business, or any loss that was not reasonably foreseeable when you started using Nova.

20. Your responsibility to us

If you publish something on Nova that causes a claim against us — a defamatory review, content that infringes somebody’s rights, or anything you posted unlawfully — you agree to be responsible for the reasonable costs and damages that result, to the extent the claim is caused by your deliberate or negligent act. This does not make you responsible for our own negligence or breach, and it applies only to content you submitted or laws you broke.

21. If something goes wrong

Email support@heynova.org and tell us what happened. We aim to acknowledge within 10 working days and to resolve complaints within 30 days.

To report a review, use the report link on the review itself. For anything about your personal information, see the Privacy Policy — and you can complain to the Information Commissioner’s Office (ico.org.uk) in the UK, or the Office of the Australian Information Commissioner (oaic.gov.au) in Australia, at any time.

22. Changes to these terms

We may update these terms. For minor changes we will update this page and the date at the top. For changes that materially affect your rights — what you pay, what happens to your information, or what we may publish — we will tell you in the app before they take effect and ask you to accept them. If you do not accept, you can keep using the parts of Nova that are unaffected, or close your account and export your record first.

23. Transferring these terms

You may not transfer your rights under these terms to anybody else. We may transfer ours if our business is sold or reorganised — if that happens we will tell you in the app beforehand, your rights under these terms will not be reduced, and the new owner will be bound by the Privacy Policy in force at the time. If you would rather not continue, you can export your record and close your account.

24. General

If any part of these terms turns out to be unenforceable, that part is limited or removed to the smallest extent necessary and the rest continues to apply.

These terms, the Privacy Policy and any feature-specific guidelines we publish are the whole agreement between us about Nova. That does not limit our responsibility for anything we told you that was untrue.

Nobody other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.

If we do not enforce a term straight away, we have not given up the right to enforce it later.

25. Governing law

United Kingdom: these terms are governed by the law of England and Wales, and disputes go to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings there.

Australia: these terms are governed by the law of New South Wales, with disputes going to the non-exclusive jurisdiction of its courts. Nothing here excludes, restricts or modifies any right, remedy or guarantee under the Australian Consumer Law or any other law that cannot be excluded.

Elsewhere: these terms are governed by the law of England and Wales and disputes go to the non-exclusive jurisdiction of its courts. If the consumer law of the country you live in gives you protections that cannot be contracted out of, those still apply.
